These Terms of Service govern your access to and use of dogallergytest.us, including its content, products, sample-collection kits, laboratory testing services, reports, customer support, accounts, and related features.

The website and services are operated by Cansoft Technologies Corp., operating as Dog Allergy Test. In these Terms, “Dog Allergy Test,” “we,” “us,” and “our” refer to Cansoft Technologies Corp.

By visiting the website, creating an account, placing an order, submitting a sample, or using a service, you agree to these Terms and our Privacy Policy. Please do not use the website or order a service if you do not agree to these Terms.

1. Eligibility and authority

You must be at least 18 years old and legally capable of entering into a binding agreement to place an order or submit a sample.

By using the service, you confirm that:

  • You are at least 18 years old.
  • You are the owner or authorized caretaker of the animal being tested.
  • You have authority to authorize the collection, submission, and testing of the animal’s sample.
  • The information you provide is accurate, current, and complete.
  • Your use of the website and services complies with applicable law.

You may not use another person’s identity, payment information, address, or account without permission.

2. Nature of our services

Dog Allergy Test provides at-home sample-collection kits and arranges laboratory analysis of submitted animal samples. Testing may be completed by an independent laboratory or testing provider acting on our behalf.

The product page, checkout page, order confirmation, and kit instructions describe the selected test, including the sample type, tested items, collection method, price, and estimated turnaround time.

By submitting a sample, you authorize us to provide the sample and information reasonably required to fulfill your order to the relevant laboratory, fulfillment provider, courier, or other service provider.

3. Veterinary and medical disclaimer

The website, product descriptions, articles, reports, customer-support communications, and testing services are provided for general informational and screening purposes.

They are not a substitute for:

  • A veterinary examination.
  • Advice from a licensed veterinarian.
  • A veterinary diagnosis.
  • Emergency veterinary treatment.
  • A treatment, medication, or dietary plan prescribed by a veterinarian.

A test result may provide information about possible reactions or sensitivities to substances included in the selected panel. A result does not, by itself, establish a clinical allergy diagnosis or identify the cause of every symptom.

Do not start, stop, or change an animal’s medication, treatment, supplements, or diet solely because of a test result. Discuss the result and any proposed changes with a licensed veterinarian familiar with the animal’s medical history.

Seek immediate veterinary care if an animal has difficulty breathing, severe swelling, collapse, persistent vomiting, seizures, or another urgent symptom. Do not delay emergency care while waiting for a test result.

4. Testing limitations

All testing has limitations, and no test can guarantee that every allergy, sensitivity, health condition, or cause of symptoms will be identified.

Results may be affected by factors including:

  • The type, age, condition, quantity, or quality of the sample.
  • Incorrect collection, labeling, drying, storage, packaging, or shipping.
  • Contamination or mixing of samples.
  • The animal’s age, health, immune response, diet, medication, or treatment.
  • Shipping delays or environmental conditions.
  • Substances not included in the selected panel.
  • The technical limitations of the laboratory method used.

Do not stop prescribed medication before collecting a sample unless instructed by a licensed veterinarian.

5. Orders and acceptance

Submitting an order is an offer to purchase the selected product or service. An automated confirmation means that we received your order. It does not necessarily mean that the order has been accepted or processed.

We may decline, cancel, or limit an order when:

  • A product or service is unavailable.
  • Pricing or product information contains an obvious error.
  • Payment cannot be authorized or verified.
  • Fraud, misuse, or unauthorized activity is suspected.
  • The delivery address is incomplete or outside a supported area.
  • The requested service cannot legally or technically be provided.
  • The selected laboratory is unable to perform the test.

If we cancel a paid order before supplying the service, we will refund the amount paid for the canceled portion of the order.

6. Prices, payment, and taxes

Prices are displayed in U.S. dollars unless another currency is clearly shown.

The total shown at checkout may include the test, sample-collection kit, shipping, taxes, and other disclosed charges. You are responsible for reviewing the total amount before placing the order.

You authorize us and our payment-service providers to charge the payment method submitted with your order.

We may correct an obvious pricing, calculation, or listing error. If a correction increases the amount payable after an order has been placed, we will request your approval before proceeding or cancel and refund the affected order.

7. Kit shipping and delivery

Testing kits will be sent to the delivery address provided with the order. You are responsible for ensuring that the recipient’s name, address, email address, and telephone number are complete and accurate.

We are not responsible for delays, returned shipments, losses, or additional costs caused by incorrect or incomplete information supplied by the customer.

Delivery dates are estimates unless we expressly provide a written delivery guarantee. Delivery may be affected by courier operations, postal services, weather, customs, holidays, service interruptions, or other circumstances outside our reasonable control.

Contact us promptly if a package arrives damaged or has not arrived within a reasonable time.

8. Sample collection

You must read and follow all instructions provided with the kit.

You are responsible for:

  • Confirming that the kit is intended for the correct test.
  • Collecting the sample from the correct animal.
  • Using the supplied collection materials as directed.
  • Avoiding contamination.
  • Labeling the sample accurately.
  • Allowing the sample to dry when required.
  • Completing all required forms.
  • Packaging and returning the sample correctly.

Sample collection must be performed safely and without unnecessary pain or distress to the animal. Stop the collection attempt and contact a veterinarian if the required sample cannot be collected safely.

We are not responsible for injury, distress, or property damage caused by unsafe animal handling or failure to follow the provided instructions.

9. Returning samples

Samples must be returned to the address stated in the kit instructions. A sample sent to a different address may be delayed, damaged, lost, or rejected.

Unless the product page, checkout page, or kit instructions expressly state otherwise, the customer is responsible for the cost of returning the sample.

We recommend using a tracked shipping method and retaining the tracking number until delivery is confirmed.

We are not responsible for a sample before it is received by the correct laboratory or processing location.

10. Turnaround times

Any turnaround time stated on the website, product page, order confirmation, kit, or communication is an estimate unless expressly guaranteed in writing.

Laboratory turnaround begins only after:

  • The correct laboratory receives the sample.
  • The sample and required documents are accepted.
  • Required payment has been completed.
  • The laboratory has all information needed to begin testing.

Turnaround estimates do not include kit delivery, sample-return shipping, weekends, public holidays, recollection, payment delays, incomplete information, additional laboratory review, or circumstances outside our reasonable control.

11. Unsuitable, insufficient, or failed samples

A sample may be rejected or may fail to produce a result if it is insufficient, contaminated, damaged, degraded, incorrectly collected, mislabeled, improperly stored, or otherwise unsuitable for testing.

If testing fails because of a confirmed laboratory error, we may arrange repeat testing or another reasonable remedy without an additional laboratory testing charge.

If testing fails because of sample quality, collection, labeling, storage, packaging, shipping, contamination, or failure to follow instructions, the customer may be responsible for:

  • Collecting a new sample.
  • A replacement-kit charge.
  • Additional shipping costs.
  • Recollection expenses.
  • An applicable retesting fee.

We will explain the available options before charging an additional fee.

12. Reports and results

Results are normally delivered electronically to the email address or customer account associated with the order.

You are responsible for:

  • Providing an accurate and working email address.
  • Checking spam and junk folders.
  • Protecting access to your email and account.
  • Downloading and securely storing your report.
  • Informing us promptly if your contact information changes.

A report applies only to the animal and sample identified in the submission. It must not be altered, misrepresented, or presented in a way that changes its meaning.

You may share the report with the animal’s veterinarian or another person authorized by you.

We may issue a corrected report to address a clerical, formatting, identification, or administrative error. A corrected report replaces the earlier version.

13. Cancellations, returns, and refunds

Before dispatch

An order canceled before the kit has been prepared or dispatched may be eligible for a full refund.

After dispatch

After a kit has been prepared or dispatched, shipping, handling, processing, and nonrecoverable kit costs may be deducted from any refund, to the extent permitted by law.

A returned kit must be unopened, unused, undamaged, and suitable for resale. Contact us before returning a kit. Unauthorized returns may be refused.

After sample submission or testing

Once a sample has been submitted, received, registered, processed, or testing has begun, the testing fee is generally nonrefundable because laboratory services and resources have been committed.

A refund will not be issued solely because:

  • The result is negative, inconclusive, unexpected, or unwanted.
  • The result does not identify the expected substance.
  • The animal’s symptoms continue.
  • A substance is not included in the purchased panel.
  • The customer changes their mind after testing begins.
  • The completed report is not downloaded, reviewed, or used.

Our error

If we cannot provide the purchased service because of our error or a confirmed laboratory error, we may provide a replacement kit, repeat testing, correction, partial refund, or full refund, depending on the circumstances.

Nothing in this section limits a cancellation, refund, warranty, or consumer right that cannot legally be excluded.

Approved refunds will normally be issued to the original payment method. Processing times may depend on the payment provider or financial institution.

14. Accounts and security

Some website features may permit or require a customer account.

You are responsible for:

  • Providing accurate account information.
  • Keeping login credentials confidential.
  • Restricting access to your device and account.
  • Updating information when it changes.
  • Notifying us of suspected unauthorized use.

We may suspend or restrict an account that we reasonably believe is being used fraudulently, unlawfully, abusively, or in violation of these Terms.

You may download and retain a purchased report for your records and provide it to the animal’s veterinarian.

You may not reproduce, modify, sell, publish, distribute, frame, or create derivative works from website content without prior written permission, except where permitted by law.

18. Third-party services and links

The website may use or link to services provided by laboratories, couriers, payment processors, hosting providers, veterinarians, or other third parties.

Third parties may have their own terms and privacy practices. We do not control an unrelated third-party website or service and are not responsible for its independent content, availability, or conduct.

A link does not mean that we endorse every statement, product, or service offered by the third party.

19. Service changes and availability

We may add, remove, suspend, or modify website features, product descriptions, test panels, prices, laboratories, collection methods, delivery options, or service details.

We will not materially reduce a service already purchased without providing an appropriate alternative, adjustment, or refund where required.

We may temporarily suspend services for maintenance, security, technical issues, laboratory availability, legal requirements, or circumstances outside our reasonable control.

20. Disclaimer of warranties

To the maximum extent permitted by law, the website, content, kits, reports, and services are provided on an “as available” basis.

We do not guarantee that:

  • The website will always be uninterrupted or error-free.
  • Every sample will produce a result.
  • Every possible allergen, sensitivity, or condition will be identified.
  • A result will explain every symptom.
  • A particular treatment or dietary change will be effective.
  • Delivery or testing will be completed by a particular date.
  • Third-party systems and services will always be available.

We do not exclude warranties, guarantees, or consumer rights that cannot legally be excluded.

21. Limitation of liability

To the maximum extent permitted by law, Dog Allergy Test, Cansoft Technologies Corp., and their officers, employees, contractors, laboratories, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential losses arising from the website or services.

This includes, where legally permitted, loss resulting from:

  • Delayed shipping or laboratory testing.
  • Loss or damage of a sample in transit.
  • Failure to follow collection instructions.
  • An unsuitable, contaminated, or mislabeled sample.
  • Decisions made without veterinary advice.
  • Unauthorized account access caused by failure to protect login credentials.
  • Service interruptions.
  • Reliance on general website information as a substitute for veterinary care.

To the maximum extent permitted by law, our total liability for a claim relating to a purchased product or service will not exceed the amount paid for the product or service giving rise to the claim.

These limitations do not apply to fraud, willful misconduct, gross negligence, death or personal injury caused by negligence where liability cannot legally be limited, or another liability that applicable law does not permit us to exclude.

22. Customer responsibility for claims

To the extent permitted by law, you are responsible for reasonable losses, liabilities, and expenses resulting from:

  • Your unlawful use of the website or services.
  • Your material violation of these Terms.
  • Information or samples submitted without proper authority.
  • Fraud or intentional misrepresentation.
  • Infringement of another person’s rights.
  • Misuse, alteration, or misrepresentation of a report.

This section does not require you to compensate us for a loss caused by our own negligence, unlawful conduct, or breach of these Terms.

23. Events outside our control

We are not responsible for delay or failure caused by events outside our reasonable control, including:

  • Severe weather or natural disaster.
  • Fire, flood, epidemic, or public-health emergency.
  • War, terrorism, civil disturbance, or government action.
  • Postal, courier, customs, or transportation disruption.
  • Labor disputes or supply shortages.
  • Utility, internet, or telecommunications failures.
  • Cyberattacks not caused by our failure to use reasonable safeguards.
  • Interruption of laboratory operations.

We will take reasonable steps to reduce the effect of the event and resume affected services when reasonably possible.

24. Suspension and termination

We may suspend or terminate access to the website or an account when we reasonably believe that:

  • These Terms have been materially violated.
  • The website is being used unlawfully or fraudulently.
  • Suspension is necessary to protect users, systems, laboratories, or service providers.
  • Suspension is required by law or a competent authority.

Termination does not affect payment obligations, rights, or liabilities that arose before termination.

25. Governing law and disputes

These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable there, without regard to conflict-of-law principles.

The courts located in British Columbia will have jurisdiction over disputes relating to these Terms, except where applicable consumer law gives you the right to bring a claim in another jurisdiction.

Before starting formal proceedings, you and Dog Allergy Test agree to make a reasonable effort to resolve the dispute by contacting the other party and clearly describing the issue.

Nothing in these Terms removes a consumer right or legal remedy that cannot be waived under the law applicable to you.

26. Changes to these Terms

We may update these Terms to reflect changes in our services, technology, business practices, or legal obligations.

The revised Terms will be posted on this page with an updated effective date. Material changes will apply prospectively unless applicable law permits otherwise.

The Terms in effect when an order is accepted will normally govern that order. Continued use of the website after revised Terms become effective means that the revised Terms apply to future use.

27. General provisions

Severability

If any provision of these Terms is found unenforceable, that provision will be limited or removed only to the extent necessary. The remaining provisions will continue in effect.

No waiver

Failure to enforce a provision of these Terms does not waive our right to enforce it later.

Assignment

You may not transfer your rights or obligations under these Terms without our written consent.

We may transfer our rights or obligations as part of a merger, acquisition, corporate reorganization, sale of assets, or transfer of the business, provided that your legal rights are not materially reduced.

Entire agreement

These Terms, our Privacy Policy, the applicable product description, the order confirmation, and any additional written terms presented at checkout form the entire agreement concerning the relevant service.

If there is a conflict, product-specific terms or terms presented at checkout will control for that purchase, followed by these Terms and then general website content.
